Terrorist organization of two peopleHuseyin Ataol, a lawyer representing [former Istanbul Police Department Intelligence Bureau Chief] Ali Fuat YIlmazer [who was arrested on charges of illegal wiretapping as part of a major operation against top police officers on July 22] said incredible things on a political TV show on Saturday. According to the lawyer, YIlmazer is accused of being a member of a terrorist organization.

What is more interesting is that the alleged “terrorist organization” consists of two people. Of course, if there are any officers involved in crime or spying they should be prosecuted and punished.

However, we have penal codes that define the elements of a crime and indicate the rules that have to be followed while prosecuting suspects. Our penal codes include two types of illegal organization: 1) A simple crime organization, which is defined in Article 220 of the Turkish Penal Code (TCK).

This is an organization comprising at least three people who have come together in order to commit crime. It has a hierarchical system and its criminal acts are repeated.

2) An armed organizationterrorist organization. As per the Counterterrorism Law (TMK) and the TCK, this kind of organization has to consist of at least three members.
